1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of ReservationFinder ("we," "us," "our," or the "Service"), including our website at reservationfinder.io, reservation monitoring tools, email alerts, SMS alerts, and related services.

By creating an account, subscribing to a plan, enabling notifications, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What ReservationFinder Does

ReservationFinder monitors publicly available reservation availability from third-party restaurant and venue platforms and sends alerts when matching openings are detected.

• We monitor availability across supported platforms such as Resy, OpenTable, Tock, and SevenRooms.
• We send notifications based on the restaurants, dates, party sizes, times, and preferences you configure.
• You are responsible for completing any reservation directly with the restaurant or third-party reservation platform.

3. Third-Party Platforms and Restaurants

ReservationFinder is independent and is not affiliated with, endorsed by, or sponsored by Resy, OpenTable, Tock, SevenRooms, any restaurant, or any venue unless we expressly state otherwise.

• Your use of third-party reservation platforms is also governed by their own terms and policies.
• Restaurants and platforms may change availability, booking rules, cancellation rules, fees, or access at any time.
• We are not responsible for third-party platform outages, booking errors, cancellations, or changes to restaurant policies.

4. Accounts and Eligibility

You must be at least 18 years old to use ReservationFinder. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

• Provide accurate account, billing, and contact information.
• Keep your notification preferences and contact details current.
• Notify us promptly if you believe your account has been accessed without authorization.

5. Subscriptions, Billing, and Cancellations

Some ReservationFinder features require a paid subscription. Subscription prices, included features, monitor limits, and notification channels are shown at checkout or in your account.

• Subscriptions renew automatically unless canceled before the next billing date.
• Payments are processed by Stripe. We do not store your full payment card number.
• You can cancel your subscription through your account settings or by contacting support.
• Cancellation stops future renewals but does not automatically refund prior charges unless required by law or expressly stated by us.
• We may change pricing or plan features, but material changes will apply prospectively after reasonable notice.

6. Notification Services

ReservationFinder may send email, SMS, and other notifications related to your account, monitors, subscription, and reservation availability. Notification delivery depends on third-party providers, carriers, network conditions, and your device settings.

• Availability alerts are time-sensitive and may be delayed or fail to deliver.
• You are responsible for checking the reservation platform before making plans.
• You can manage notification preferences in your account settings where available.

7. SMS Messaging Terms

When you enable SMS notifications, you opt in to receive transactional reservation availability text alerts from ReservationFinder at the mobile number you provide. SMS notifications are optional and are not a condition of purchasing or using a paid plan.

You represent that you are the account holder or customary user of any mobile number you provide. If your number changes or you no longer control the number, update your account settings or disable SMS notifications promptly.

8. Acceptable Use

You agree not to misuse ReservationFinder or interfere with the Service. You may not:

• Use the Service for unlawful, abusive, fraudulent, or harmful activity.
• Reverse engineer, scrape, overload, or disrupt the Service.
• Share, resell, or commercially exploit the Service without our written permission.
• Use automated systems to access the Service except through features we provide.
• Interfere with other users, restaurants, or third-party platforms.

9. Intellectual Property

ReservationFinder, including our website, design, software, content, logos, and related materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you ownership of any part of the Service.

10. Service Changes and Availability

We may modify, suspend, or discontinue any part of the Service at any time. We may also add or remove supported restaurants, cities, platforms, notification channels, or plan features. We are not liable for interruptions, delays, or unavailability of the Service.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

12. Limitation of Liability

To the fullest extent permitted by law, ReservationFinder and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost reservations, lost opportunities, loss of data, or service interruptions. Our total liability for any claim related to the Service will not exceed the amount you paid to ReservationFinder in the three months before the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless ReservationFinder from claims, damages, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your account or access to the Service if you violate these Terms, create risk for the Service or other users, fail to pay amounts due, or use the Service in a way that may harm ReservationFinder, restaurants, third-party platforms, or others. You may stop using the Service at any time.

15. Privacy

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice through the Service or by email. Your continued use of the Service after changes become effective means you accept the updated Terms.

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, unless applicable law requires otherwise.
